Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of services provided by KOVE APARTMENTS PTY LIMITED (“Kove Apartments,” “we,” “our,” or “us”) located at 10 Bong Bong Street, Kiama NSW 2533, Australia. By making a booking or using our services, you agree to these Terms, our Privacy Policy, and Cancellation Policy.

2. Booking and Payment Terms

2.1 Reservations

• Full payment required upon booking
• Valid credit card required for security deposit
• All rates in Australian Dollars (AUD) including GST
• Rates subject to change without notice

2.2 Security Deposits

• Studios: $250 bond/holding deposit
• 2 & 3 Bedroom Apartments: $500 bond/holding deposit
• Refundable subject to satisfactory room inspection
• Processing time: 3-10 business days
• Deductions may apply for damages, lost items, or additional cleaning

2.3 Cancellation Terms

As per our Cancellation Policy:

• Tiered refund structure
  • 28+ days: 100% refund
  • 14-27 days: 50% refund
  • 7-13 days: 25% refund
  • Under 7 days: No refund

3. Check-in and Check-out

3.1 Times

• Check-in: from 3:00 PM (unless prior arrangements have been agreed upon by management) 
• Check-out: by 10:00 AM

3.2 Requirements

• Valid government-issued ID for check-in
• Credit card for security deposit
• Must be 18 years or older to book

4. Accommodation Rules

4.1 General Conduct

• No smoking (violation incurs fees)
• No parties or unauthorized gatherings
• Noise must not disturb other guests
• Follow staff instructions
• Maximum occupancy strictly enforced

4.2 Property and Facilities

• One parking space per apartment (2.7m clearance)
• No boats or trailers
• Proper use of amenities required
• Report damages immediately

5. Guest Responsibilities

5.1 Room Care

• Maintain reasonable cleanliness
• Use facilities appropriately
• Report maintenance issues promptly
• No unauthorized modifications
• Responsible for guest behaviour

5.2 Security

• Secure apartment when absent
• Do not share access credentials
• Report suspicious activity
• Follow emergency procedures

6. Prohibited Activities

• Smoking anywhere on property
• Unauthorized parties/gatherings
• Excessive noise
• Illegal activities
• Damage to property
• Unauthorized guests
• Commercial photography without permission
• Pet accommodation (unless service animal)

7. Liability and Damages

7.1 Guest Liability

• Responsible for all damages
• Liable for missing items
• Accountable for guest behaviour
• Responsible for personal belongings

7.2 Property Liability

• Not responsible for lost/stolen items
• Not liable for vehicle damage
• Not responsible for personal injuries
• Not liable for construction inconvenience
• Force majeure events excluded

8.1 Information Collection

• Booking preferences

8.2 Information Use

• Booking processing
• Security purposes

9. Termination of Stay

We reserve the right to terminate stays for:

• Policy violations
• Disruptive behaviour
• Non-payment
• False information
• Legal requirements

10. Changes to Terms

• Subject to change without notice
• Changes effective immediately
• Continued use implies acceptance
